Terms of Service

By purchasing or using CalNative Booking, you agree to these terms. Please read them carefully before completing your purchase.

01Agreement to terms

These Terms of Service ("Terms") govern your access to and use of CalNative Booking (the "Plugin"), a WordPress plugin developed and sold by CalNative Booking ("we", "us", or "our"). By purchasing a license, downloading, installing, or using the Plugin, you agree to be bound by these Terms.

If you do not agree to these Terms, do not purchase, download, or use the Plugin. These Terms apply to all purchasers and end users of the Plugin.

By accepting these Terms, you represent that you are at least 18 years of age and have full legal capacity to enter into a binding agreement. If you are purchasing on behalf of a company or organisation, you represent that you have authority to bind that entity to these Terms.

Your use of the Plugin is also subject to our Privacy Policy and Refund Policy, each of which is incorporated into these Terms by reference.

Plain English summary You get a license to use the plugin on one website. You cannot resell, redistribute, or claim the code as your own. Your license renews annually and you can cancel any time. The Privacy Policy and Refund Policy are part of the deal too.

02License grant

Subject to your compliance with these Terms and payment of the applicable license fee, we grant you a non-exclusive, non-transferable, revocable license to:

  • Install and activate the Plugin on one (1) WordPress website that you own or manage.
  • Use the Plugin for its intended purpose — embedding a Google Calendar booking widget on that website.
  • Receive updates and bug fixes released during your active license period.
  • Access email support for issues related to the Plugin during your active license period.

This license is personal to you and the single website specified at the time of purchase. It does not constitute a transfer of ownership of the Plugin or any of its components. You may not assign or transfer your license to any other person or entity.

03Restrictions

You may not, and may not permit others to:

  • Use the Plugin on more than one website without purchasing additional licenses.
  • Copy, redistribute, resell, sublicense, or transfer the Plugin or your license key to any third party.
  • Modify, adapt, translate, reverse-engineer, decompile, or disassemble the Plugin, except to the extent expressly permitted by applicable law.
  • Remove or alter any copyright, trademark, or proprietary notices contained in the Plugin.
  • Use the Plugin to develop a competing product or service.
  • Use the Plugin in any way that violates applicable local, national, or international law or regulation.

Violation of these restrictions may result in immediate termination of your license without refund and may expose you to civil or criminal liability.

04Payment & billing

The Plugin is sold as an annual subscription priced at $39 per website per year. The following billing terms apply:

All payments and license management are handled by Freemius, our third-party billing and licensing platform. By completing a purchase you also agree to the Freemius Terms of Service. CalNative Booking never stores or directly processes payment card information — all card data is handled securely by Freemius.

Auto-renewal

Your license renews automatically each year at the then-current renewal price. You will be notified by email before each renewal. You may cancel auto-renewal at any time before the renewal date through your Freemius account dashboard or by contacting us.

Price changes

We reserve the right to change our subscription pricing at any time. If we increase the price of a renewal, we will notify you at least 30 days in advance by email. Your continued subscription after the notified date constitutes acceptance of the new price. If you do not accept the new price, you may cancel before the renewal date at no charge.

Refunds

We offer a 30-day money-back guarantee on original purchases. Full terms, eligibility conditions, and the refund process are set out in our Refund Policy, which forms part of these Terms.

Taxes

All prices are exclusive of applicable taxes. You are responsible for any sales tax, VAT, or other government-imposed taxes applicable to your purchase. Where we are required by law to collect tax, it will be added to your invoice.

05Updates & support

An active license entitles you to:

  • All Plugin updates released during your 12-month license period, including new features, compatibility fixes, and security patches.
  • Email support for installation issues, configuration questions, and bug reports. We aim to respond to all support requests within one business day.

After your license expires, the Plugin will continue to function with the version you have installed, but you will no longer receive updates or support until you renew. We strongly recommend keeping your license active to ensure compatibility with future versions of WordPress and Google's Calendar API.

We do not guarantee support response times beyond our stated aim, and we reserve the right to discontinue support for older Plugin versions when a newer version is available.

06Third-party services

The Plugin integrates with third-party services that are outside our control. By using the Plugin, you acknowledge the following:

Google Calendar API

The Plugin relies on the Google Calendar API to read availability and create booking events. Your use of Google's services is governed by Google's Terms of Service and Google's Privacy Policy. We are not affiliated with Google and have no control over changes to, or the availability of, the Google Calendar API.

If Google modifies, restricts, or discontinues the Calendar API, certain Plugin features may be reduced or may stop working entirely. We will endeavour to update the Plugin accordingly, but such changes are beyond our control and do not entitle you to a refund beyond the 30-day guarantee window.

WordPress

The Plugin is designed for use with WordPress. We target compatibility with actively supported WordPress versions. We are not responsible for incompatibilities caused by third-party plugins, themes, or customisations to your WordPress installation.

Hosting environment

Plugin performance depends on your hosting environment. We do not guarantee that the Plugin will function on all server configurations. Hosting-related issues fall outside the scope of our support.

Your responsibilities as a plugin user

CalNative Booking is a plugin vendor — we do not operate a booking service and we have no access to data collected by the Plugin on your website. When your site visitors submit a booking through the Plugin, that data (name, email, appointment details) is stored in your WordPress database and your Google Calendar only. You are solely responsible for:

  • Complying with applicable data-protection laws (including UK GDPR, EU GDPR, or other local legislation) as the data controller for your website visitors' personal data.
  • Maintaining a privacy policy on your website that accurately describes how you collect, use, store, and delete your visitors' booking data.
  • Obtaining any necessary consents from your site visitors before collecting their personal information through the booking form.
  • Securing the server and database where booking data is stored.

We accept no liability for your failure to meet these obligations. Our Privacy Policy covers only data we collect from you as a license purchaser on this website.

07Intellectual property

The Plugin, including all code, design, graphics, documentation, and related materials, is the exclusive intellectual property of CalNative Booking and is protected by copyright and other applicable intellectual property laws.

These Terms do not transfer any ownership rights to you. Your license grants only the limited right to use the Plugin as described herein. All rights not expressly granted are reserved by us.

CalNative Booking, its logo, and related marks are trademarks of CalNative Booking. You may not use these marks without our prior written permission.

08Disclaimer of warranties

The Plugin is provided "as is" and "as available" without warranties of any kind, either express or implied, including but not limited to:

  • Implied warranties of merchantability, fitness for a particular purpose, or non-infringement.
  • Any warranty that the Plugin will be uninterrupted, error-free, or free of harmful components.
  • Any warranty regarding the accuracy or reliability of results obtained through the Plugin.
  • Any warranty that the Plugin will remain compatible with future versions of WordPress, PHP, or the Google Calendar API.

Some jurisdictions do not allow the exclusion of implied warranties, so the above exclusion may not apply to you in full. Your use of the Plugin is at your own risk.

09Limitation of liability

To the fullest extent permitted by applicable law, CalNative Booking and its developers, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of or inability to use the Plugin, including but not limited to:

  • Loss of revenue, data, goodwill, or business opportunities.
  • Any interruption of service or loss of use of your website.
  • Any missed bookings or scheduling errors caused by Plugin malfunction or third-party API failure.
  • Any third-party claims, including claims related to Google Calendar API usage or data stored in Google's systems.

In no event shall our total aggregate liability to you for all claims related to the Plugin exceed the amount you paid for your current license period.

Nothing in these Terms limits or excludes our liability for death or personal injury caused by our negligence, fraud or fraudulent misrepresentation, or any other liability that cannot be excluded by law.

10Termination

Your license is effective from the date of purchase and continues until it expires or is terminated. We may terminate your license immediately and without notice if you breach any provision of these Terms.

Upon termination, you must cease all use of the Plugin and delete all copies from your systems. The following sections shall survive termination: Intellectual property, Disclaimer of warranties, Limitation of liability, Governing law, and General provisions.

You may cancel your subscription at any time through your Freemius account dashboard or by contacting us. Cancellation takes effect at the end of the current billing period. No partial refunds are issued for unused time outside the 30-day guarantee window described in our Refund Policy.

11Governing law

These Terms are governed by and construed in accordance with the laws of England and Wales, without regard to its conflict of law provisions.

Any dispute arising out of or in connection with these Terms that cannot be resolved amicably shall be subject to the exclusive jurisdiction of the courts of England and Wales, except that:

  • If you are a consumer resident in another jurisdiction, you may also bring proceedings in the courts of your country of residence.
  • If you are resident in the European Union, you may use the EU Online Dispute Resolution platform at ec.europa.eu/consumers/odr.

Nothing in this clause affects your rights as a consumer under the laws of your country of residence.

12General provisions

Entire agreement

These Terms, together with the Privacy Policy and Refund Policy, constitute the entire agreement between you and CalNative Booking regarding the Plugin and supersede all prior agreements and understandings.

Amendments

We may update these Terms from time to time. When we make material changes, we will update the "Last updated" date at the top of this page and notify active license holders by email. Your continued use of the Plugin after the effective date of the updated Terms constitutes acceptance. If you do not agree to the changes, you may cancel your license before the effective date.

Severability

If any provision of these Terms is found to be invalid, illegal, or unenforceable, the remaining provisions will continue in full force and effect. The invalid provision will be modified to the minimum extent necessary to make it enforceable.

Waiver

Our failure to enforce any right or provision of these Terms will not be considered a waiver of that right or provision. A waiver is only effective if made in writing and signed by an authorised representative of CalNative Booking.

No partnership or agency

Nothing in these Terms creates a partnership, joint venture, agency, employment, or franchise relationship between you and CalNative Booking.
